Buyer’s Agent Fees in Sydney: What Are You Actually Paying For?

Discussions about buyer’s agent fees in Sydney often begin with a percentage or a fixed dollar figure. That is understandable, but it is not enough to compare two services properly.
The more useful question is: what work, authority and responsibility sit behind the fee, and where does the service begin and end? A lower quote may cover only attendance at an auction. A higher quote may include months of search, inspections, analysis, due diligence coordination, negotiation and representation through exchange of contracts.
Are buyer’s agent fees regulated in NSW?
The amount is not set by law. NSW Government guidance confirms that buyer’s agents may charge a fixed fee or a percentage of the purchase price, and that the amount can be negotiated.
What is regulated is the need for a written agency agreement. The Buyer’s Agency Agreement should set out the services, fees, payment terms, authority and other conditions of the engagement. A buyer should understand those terms before signing.
The two most common fee structures
Fixed fee
A fixed fee is commonly used where the property has already been identified and the scope is relatively defined. This may include target-property analysis, negotiation, auction bidding or a combination of those services.
The advantage is certainty: the buyer knows the agreed fee before the transaction proceeds. The buyer should still confirm whether the fee changes if the property is sold before auction, passed in, withdrawn or not purchased.
Percentage-based fee
A percentage-based fee is commonly used for a full search and acquisition service because the work can extend across the search, inspections, analysis and multiple transactions before the eventual purchase.
The percentage alone does not explain the total fee. Buyers should confirm the purchase-price basis, any minimum fee, whether GST is additional, when the fee becomes payable and whether an initial engagement payment forms part of the total.
Why quotes can differ substantially
A buyer’s agency quote can vary because the underlying work varies. Relevant factors may include:
• whether the service is auction attendance, target-property negotiation or full search;
• the geographic area and number of markets being covered;
• the property type and level of specialist coordination required;
• the number of inspections and shortlisted properties;
• whether negotiation and auction bidding are both included;
• the reporting and communication expected;
• the duration and termination terms of the engagement; and
• whether the service ends at offer acceptance, exchange of contracts or settlement.
A meaningful comparison requires the same scope to be placed beside the same scope. Otherwise, the buyer may be comparing a limited transaction service with a full acquisition mandate.
What should be clear in the Buyer’s Agency Agreement?
• the precise service being provided;
• the property brief or target-property scope;
• the agent’s authority to communicate, negotiate or bid;
• the fee, GST treatment and payment timing;
• any engagement payment, retainer or minimum fee;
• third-party costs that are not included;
• the circumstances in which a fee becomes payable;
• termination and expiry provisions;
• any material conflicts, rebates or referral arrangements; and
• the service completion point.
These are not administrative details. They define what the buyer is purchasing and what the agent is accountable for delivering.
Price advice is not the same as a formal valuation
Buyers should also understand what is meant by ‘appraisal’, ‘market assessment’ or ‘price guidance’. A buyer’s agent can analyse comparable evidence and recommend a buying framework. That is different from a formal valuation prepared by a suitably qualified independent valuer.
If a lender, court, tax adviser or other party requires a formal valuation, that service should be separately commissioned from the appropriate professional.
What value should a buyer expect?
A buyer’s agent should not be judged only by whether the final price is lower than the asking price or whether a claimed saving exceeds the fee. Those comparisons can be misleading because the true market value and the counterfactual purchase price cannot always be known.
The value may also include identifying suitable opportunities earlier, reducing time spent on unsuitable properties, coordinating the buying process, interpreting the available transaction context, maintaining discipline in competition and advising the buyer not to proceed where the property, price or risk does not make sense.
The fee pays for a defined professional service. It should not be presented as a guarantee of a discount or a guaranteed purchase.
Questions worth asking before you compare the numbers
• Who does the agency represent, and how are conflicts handled?
• What work is completed before an offer or auction?
• What does the agent inspect and report on directly?
• Which professional enquiries are coordinated but provided by others?
• Can the agent clearly recommend that the buyer does not proceed?
• What happens if no property is purchased?
• When does the service finish?
• Is every fee and expense stated in writing?
